NDC Gives Kenebai Two Days to Confirm Okorotie SAN’s Brief in Pending Suit
By Our Correspondent – The Nigeria Democratic Congress (NDC) has given Hon. Kenebai Bernard Sunday two working days to confirm or deny whether he authorised Senior Advocate of Nigeria (SAN), T.F. Okorotie, to represent him in a pending suit before the Federal High Court in Yenagoa.
The demand was contained in a letter dated October 22, 2026, issued through the party’s solicitors, Benson Yeindibofa & Co., and reportedly delivered to Kenebai’s private residence in Yenagoa on Monday, October 26.
Signed by E. Benson, Esq., on behalf of the NDC, the letter seeks clarification over the filing of a counter-affidavit and other court processes by Okorotie in response to the party’s originating summons.
The suit, marked FHC/YNG/CS/172/2026, is between the Nigeria Democratic Congress and Kenebai Bernard Sunday and two others before the Federal High Court, Yenagoa.
According to the solicitors, Okorotie had filed a counter-affidavit on Kenebai’s behalf before the latter was served with the originating summons.
The case seeks the court’s interpretation of documents relating to Kenebai’s First School Leaving Certificate and testimonial issued by the Bayelsa State Ministry of Education, Community Primary School 1, Isampou, alongside a First School Leaving Certificate Examination document dated June 1973 and an affidavit in support of personal particulars.
The legal questions raised include the interpretation and application of Section 66(1)(c) of the 1999 Constitution, as amended, and Section 29(2) of the Electoral Act 2026.
The NDC’s solicitors said the clarification was necessary to establish whether Kenebai had formally briefed and instructed the senior lawyer to file the counter-affidavit and accompanying processes on his behalf.
The letter reportedly stated that failure to respond within two working days would lead the solicitors to regard the lawyer’s appearance and filings as having been made on the basis of Kenebai’s brief and instructions.
However, that position reflects the solicitors’ stated interpretation of the circumstances, while any legal implications remain subject to applicable law and the court’s determination.
The letter was reportedly delivered by DHL Yenagoa at about 4:31 p.m. on Monday to Kenebai’s residence on Peres Peretu Street, GRA, Yenagoa. His security guard, identified as Mr. Thomas Joseph, reportedly signed the acknowledgement copy on his instructions.
As of the time of filing this report, no response from Kenebai was available.
The clarification request comes as the legal dispute between the NDC and the respondents continues before the Federal High Court in Yenagoa.
